ECJ: Google must respect right to be forgotten

Maciej Szpunar, advocate general at the European Court of Justice, said on Thursday that the so-called right to be forgotten in web search has limitations. In a written opinion about Google Llc's appeal against a fine in France, the adviser said the dereferencing issue also includes the "legitimate public interest in accessing the information sought" but also cited the rights to data protection and privacy. The preliminary statement will be taken into account by judges, who still need to rule on the matter.

Search engine operators like Alphabet Inc.'s subsidiary "must take every measure available" including geo-blocking to erase an individual's personal information if their request is approved, Szpunar said. However, he took the view that it doesn't have to act "beyond the borders" of the European Union or on all the domain names. The court aide still concluded such cases are possible, namely if it affects the internal market like in "competition law or trademark law."
